Three companies were fined or charged for overstating what their AI actually did.

One founder was charged with fraud after raising forty-two million dollars on fabricated AI claims — which is the extreme version of a pattern that's far more common.

Verdict

Most agentic AI on the market is a rebranded chatbot, and your Copilot stack has already added data sub-processors that never came with a consent screen — so the risk isn't hypothetical.

Before any AI contract this quarter, require a pilot log run on your actual data and a token-cost model against real volume — those two requirements close the demo-to-delivery gap before you sign.

Six months out, the measure is straightforward: count AI line items tied to a tracked business outcome versus those that produced only invoices.
